TRAFFICMAXXING · LEGAL
Terms of Service
These terms are an agreement between you and Lombardo Real Estate LLC, doing business as TrafficMaxxing ("TrafficMaxxing," "we," "us"). They cover trafficmaxxing.ai, the TrafficMaxxing OS hosted portal, the One-Click Editor, add-ons, kits we send you, and our live workshops. Please read them. If you buy or sign in, you agree to them.
We plan to move TrafficMaxxing to a new company, TMOS LLC. When that happens, these terms transfer to TMOS LLC and we'll tell you by email.
Contact: [email protected]. Our mailing address is available on request by email.
1. The short version
- You get access to tools that help you make and plan content. You review and approve everything before it goes out. You are responsible for what you publish.
- You use your own Claude subscription and your own publishing account. We don't pay for them, resell them or share them.
- Don't resell, share or copy the system.
- No results are promised. Content can reach few people or many. It depends on you.
- Renewal after your first 12 months is off unless you turn it on. You can turn it off in one click.
- Refunds are in our Refund Policy. Full refund within 30 days if your portal setup isn't finished.
- If we disagree, we talk first. Then it goes to individual arbitration under South Carolina law, not a class action. You can opt out of arbitration in your first 30 days.
The sections below are the full terms.
2. Who can use this
You must be at least 18 and able to enter a contract. TrafficMaxxing is for business use. If you sign up for a company, you confirm you can bind it, and "you" means the company too.
These terms include our Privacy Policy, Refund Policy, Results Disclaimer, Cookie Notice, Copyright and DMCA Notice and Data Requests page.
3. What you are buying
TrafficMaxxing OS (the hosted portal). New customers get 12 months of hosted access. The portal can edit your videos, transcribe your speech to text, help plan content, draft posts, and publish posts if you connect a publishing account. It runs in a private workspace we host for you. This is a license to use the system in your own business. You don't own the system, and (outside the founding customer addendum below) you don't get a copy of it to keep.
One-Click Editor. A digital product. It is a Claude Code skill kit that you download and run on your own computer, with your own Claude subscription. You get a license to use the version you download in your own business, for as long as you want. Updates are included only if the product page says so. We don't host it and we don't receive your videos when you use it on your computer.
Add-ons. Add-ons such as the Trial Reel Skill and the Scripter are digital downloads on the same terms as the One-Click Editor.
Skool communities. Our Skool communities are run through Skool. Skool's own terms apply to them as well as these terms. Skool handles Skool billing and Skool refunds.
4. Your accounts
Your own Claude subscription. TrafficMaxxing OS and the One-Click Editor run on your own Claude subscription. You sign in to Claude through Anthropic's own sign-in. Anthropic's terms and usage limits apply to you. We never pay for, resell or intermediate your Claude usage. We only run the unmodified Claude Code on your behalf, inside your workspace.
Anthropic controls Claude. It can change its limits, prices, terms or rules, or restrict how Claude Code is used, at any time. We can't promise it won't. If a change by Anthropic stops the portal from working for you and we can't fix it within 30 days, you can end your plan and we'll refund the unused part of your prepaid term (see section 14).
Your own publishing account. If you publish through Blotato or any other tool, you need your own account with that tool and your own connections to your social accounts. Their terms apply. You can use the portal without publishing automatically.
Your connectors. Any other service you connect (for example Google Drive) must be your own account. Connect only what you have the right to connect.
No sharing. Each customer must have their own Claude subscription, publishing account and connectors. Don't share logins or accounts with other people or businesses. Keep your password safe. You are responsible for activity under your login. Tell us right away if you think someone else got in.
5. Your content
Your content is yours. Videos, audio, transcripts, brand information, scripts and everything the system makes for you belong to you.
What we can do with it. You give us a limited license to host, copy, process, transcribe, edit and send your content, only as needed to run the service for you, keep it secure, fix problems, and follow the law. We don't use your content to train AI models. We don't sell it. We don't use it to make marketing for others.
Permission and rights. You promise that:
- you own your content or have the right to use it;
- you have permission from everyone who appears or speaks in your videos and audio, including clients and guests;
- you have the rights to any music, footage, images, fonts or other material you upload or add; and
- your content doesn't break the law or anyone's rights.
Faces and voices. The editor may find where a face is in a frame so it can crop or zoom the shot. It does not identify anyone. We don't create or keep face or voice templates. Speech is turned into text. We don't identify people by their voice.
AI can be wrong. The system uses AI. Its output can be inaccurate, off-brand, offensive, or the same as something else. You must review and approve what it makes before you use it. Nothing goes out unless you set it up to. You are responsible for what you publish, including claims, copyright, platform rules and laws that apply to your business and your industry.
6. Acceptable use
Don't use TrafficMaxxing to:
- make or post anything illegal, or that infringes someone's rights;
- harass, threaten or defame anyone;
- pretend to be someone else, or make fake reviews, fake testimonials or fake endorsements;
- send spam or break platform rules;
- upload malware, or try to break, probe or get around our security or other customers' workspaces;
- scrape, copy or overload the service;
- share your login or let other people use your account;
- upload video of children under 18 without a parent's or guardian's permission; or
- use the service to make or post claims about health, money or income that you can't back up.
We can remove content and suspend access if you break these rules or put others at risk.
7. No resale, no sharing, no copying
TrafficMaxxing OS, the One-Click Editor and our add-ons are licensed to you, not sold. Unless we agree in writing, you may not:
- resell, rent, sublicense, share, give away or white-label any of it, or give anyone else access to it;
- use it to make content as a service for other businesses (agency use needs a separate license, so ask us);
- copy, extract or publish its skills, prompts, instructions or code, including by asking the AI inside it to reveal them;
- repackage any of it into a competing product, course, template pack or tool; or
- remove ownership notices.
Your portal is for your business. If you add a team member, they must work in your business and use their own login. You are responsible for what they do.
We own the system and our brand. These terms give you no ownership in them.
8. Price, payment and taxes
The price is shown when you buy. You authorize us (and our payment providers, Stripe and GoHighLevel) to charge your payment method. You are responsible for any taxes that apply. We add sales tax where the law requires it. Your Claude subscription, publishing tools and other third-party services are billed separately by them and are not part of our price.
9. Renewal after your first 12 months
These are the exact renewal terms. We repeat them where you buy and where you turn renewal on.
- Your first 12 months are prepaid. They don't renew by themselves.
- Renewal is opt-in. After your first 12 months, hosted access renews monthly at the $97 per month founder rate only if you turned renewal on. You can turn it on with a checkbox at portal sign-in or in Settings, under Plan & renewal. The box is never checked for you.
- What you agree to when you turn it on. Your hosted access renews each month at $97 until you turn it off. We charge the payment method on file. Taxes are extra where required.
- You can turn it off any time. One click in Settings, Plan & renewal. Or email [email protected]. Turning it off takes effect at the end of the month you've paid for. You keep access until then. There are no partial-month refunds, except where the law requires them.
- The rate can change only with notice. We will email you at least 30 days before any price change. You can turn renewal off before the change takes effect. If you leave renewal on, the new price applies from the first renewal on or after the change date.
- Reminders. We email you before your first renewal charge, before any price change, and once a year while renewal is on. Each reminder says the price, how often you're charged, and how to cancel. We email a receipt after each charge.
- If you don't turn renewal on. Your hosted access ends when your 12 months end. You have 30 days to export your content (section 14). If you want to come back during those 30 days, email us and we'll do our best to switch your portal back on.
- Failed payments. If a renewal payment fails, we email you and may pause access until payment works.
- Our records. We keep a record of when you turned renewal on, what it said, and which version of these terms applied, for at least three years.
One-Click Editor and add-ons are one-time purchases. They do not renew.
10. Refunds
Our Refund Policy is part of these terms. In short:
- TrafficMaxxing OS: full refund within 30 days of purchase if your portal setup isn't finished. After setup is finished, or after 30 days, no refunds except where the law requires them.
- One-Click Editor and add-ons: refund within 30 days if you couldn't get it working and we couldn't fix it.
- Renewal charges: cancel any time. It takes effect at the end of the paid month. No partial refunds except where the law requires them.
11. Results
We don't promise any result. We don't promise reach, followers, views, leads, sales or income. Your results depend on your effort, niche, offer, consistency and the platforms. See our Results Disclaimer.
12. Third-party services and changes
TrafficMaxxing depends on services we don't control, including Claude, social platforms, publishing tools, Zoom, Skool and payment providers. They can change or stop. We aren't responsible for them. We may change, add or remove features. The product is still being built, and newer features may roll out in stages. We will not materially cut what you paid for during your paid term without telling you.
13. Copyright complaints
If you think something on our service infringes your copyright, see our Copyright and DMCA Notice. We may remove content and end access for people who repeatedly infringe.
14. Ending your account
You can leave. Turn renewal off, or email us to cancel. See section 9 and the Refund Policy.
We can suspend or end your account if you break these terms, put the service or other customers at risk, don't pay, or if the law requires. If we end your account for a breach, there is no refund. If we suspend you by mistake, we'll fix it.
If we shut down or can't serve you. If we shut down the service, or can no longer provide it to you because of something on our side or a provider's side that we can't fix within 30 days, we'll refund the unused part of your prepaid term.
Your data when the account ends.
- Your workspace data stays while your account is active.
- After your account ends, you can export your content for 30 days.
- We delete your workspace data within 90 days after your account ends. Backups roll off within 7 days after that.
- We may keep limited records we must keep by law, such as payment records and proof of your consent to these terms and to renewal.
What survives. The parts of these terms that by their nature should continue (for example ownership, disclaimers, limits on liability, payment, and dispute resolution) continue after your account ends.
15. Privacy
Our Privacy Policy explains what we collect and who we share it with. To ask for access, correction or deletion, see Data Requests.
16. Emails
We send two kinds of email. Marketing email (newsletters, workshop reminders, offers) always has an unsubscribe link. Product and service email (access links, receipts, renewal notices, security notices, changes to these terms) is sent separately. You can't unsubscribe from product and service email while you have an account, because you need it.
17. No warranties
TrafficMaxxing is provided "as is" and "as available." To the fullest extent the law allows, we make no warranties, express or implied, including about quality, fitness for a particular purpose, non-infringement, uptime, accuracy of AI output, or results. We don't promise the service will be uninterrupted, error-free or secure. Some places don't allow some of these exclusions, so some may not apply to you.
18. Limit on our liability
To the fullest extent the law allows:
- We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data, reputation or business opportunity, even if we were told it could happen.
- Our total liability for all claims about the service is limited to the fees you paid us in the 12 months before the event that caused the claim.
- We are not liable for problems with your Claude subscription, your publishing tools, your social accounts, or costs or penalties on those accounts.
These limits don't apply where the law doesn't allow them, for example for fraud or for harm we cause on purpose.
19. If you cause us a claim
You'll defend and reimburse us (including reasonable legal fees) for claims from other people that come from your content, what you publish, your breach of these terms, or your breach of someone else's rights or a platform's rules. We'll tell you about the claim promptly and give you reasonable help. We can take part with our own lawyer.
20. Disputes
Talk first. If you have a problem, email [email protected] and describe it. Give us 30 days to work it out before starting any formal case.
Arbitration. If we can't work it out, you and we agree that any dispute about these terms or the service goes to binding arbitration, not court, except as set out below. The American Arbitration Association (AAA) runs it under its rules that apply to the kind of dispute (its Consumer Arbitration Rules for individuals buying for personal use, otherwise its Commercial Rules). The arbitrator can award the same relief a court could. A hearing can be held by video or phone, or in person in the county where you live or in Aiken County, South Carolina. The Federal Arbitration Act applies.
Class action waiver. You and we can bring claims only on an individual basis. Neither of us can bring or join a class, collective or representative case. If this waiver is found unenforceable for a claim, that claim goes to court instead (not arbitration), and the rest of this section still applies to other claims.
Small claims. Either of us may bring an individual case in small claims court instead of arbitration if it qualifies.
Protecting our system. Either of us may go to court to stop misuse of intellectual property, for example copying our system or breaking section 7.
You can opt out of arbitration. Email [email protected] within 30 days after you first accept these terms, with the subject "Arbitration opt-out" and your name and the email you used to buy. If you opt out, disputes go to court as described next. Opting out doesn't change anything else.
Law and courts. South Carolina law governs these terms, except that the Federal Arbitration Act governs arbitration. For anything that goes to court, you and we agree to the state and federal courts in Aiken County, South Carolina, and you agree not to object to that location.
This section doesn't take away rights you have under laws that can't be waived.
21. Changes to these terms
We may update these terms. For material changes, we'll email you or post a notice in your portal, and the portal will ask you to accept the new version at your next sign-in. Changes don't apply to a dispute that began before the change. If you don't agree to a change, you can stop using the service and cancel under section 14. A material change that raises a price follows the notice rules in section 9.
22. Moving to TMOS LLC and other transfers
We plan to move TrafficMaxxing to TMOS LLC. When that happens, these terms, your license and our promises to you transfer to TMOS LLC, and we'll tell you by email. We may also transfer these terms as part of a merger or sale of the business. You can't transfer your account or license to anyone else without our written permission.
23. Notices
We'll give notices by email to the address on your account or in your portal. You agree to get notices and agreements electronically. Send notices to us at [email protected]. Keep your email address up to date.
24. The rest
These terms and the pages they link to are the whole agreement between us about TrafficMaxxing. If part of them can't be enforced, the rest still applies. If we don't enforce something right away, we haven't given it up. We aren't responsible for delays caused by things outside our control. Headings are for convenience only.
Addendum A: Founding customers
This addendum applies to customers who bought at or before the September 30, 2026 founder close, and to the other founding customers we've told you about in writing ("founding customers"). It adds to the terms above. If they conflict, this addendum wins for founding customers.
- You keep your copy. Your purchase includes a copy of the system. You may keep it and use it in your own business under section 7 of the terms. No reselling, sharing or copying.
- At 12 months, you choose.
- Renew hosting (optional). Hosting renews at the $97 per month founder rate only if you turn renewal on, under the renewal rules in section 9.
- Don't renew. We send you a ZIP of the system as of the date your 12 months end. After that date there are no further updates, hosting or support. Your content is yours either way, and you can export it during the 30 days after your account ends.
- What we promised you still stands. What we promised you in writing when you bought (for example updates, community access and the number of people on your account) stays promised for the period we promised.
- Everything else in the terms applies, including no resale, no sharing, and the dispute section. You'll be asked to accept these terms at your next sign-in. They don't take away anything you bought.
