TRAFFICMAXXING · LEGAL
Copyright and DMCA Notice
TrafficMaxxing, run by Lombardo Real Estate LLC, doing business as TrafficMaxxing, respects copyright. Customers' workspaces are private, but they hold content that customers upload and make. This page explains how to report copyright infringement and what we do about it.
Where to send a notice
Email [email protected] with the subject line "Copyright notice." Our mailing address is available on request by email.
If the content you're worried about is a public post on Instagram, TikTok, YouTube or another platform, report it to that platform too. Posts are published on those platforms, not on our servers.
What your notice must include
To be valid under the U.S. Digital Millennium Copyright Act, your notice must include:
- Your physical or electronic signature (a typed name is fine).
- A description of the copyrighted work you say was infringed.
- A description of where the material is, with enough detail for us to find it (for example, the portal address, file name or link).
- Your name, address, phone number and email.
- A statement that you believe in good faith that the use is not allowed by the copyright owner, its agent or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are allowed to act for the owner.
Please be careful. Knowingly claiming infringement when there isn't any can make you liable for damages.
What we do
When we get a complete notice, we act promptly. We may remove or disable access to the material and tell the customer who uploaded it. We may share your notice with that customer, including your contact details.
Counter-notice
If you think we removed your material by mistake, email [email protected] with the subject line "Counter-notice." Include:
- Your physical or electronic signature.
- A description of the material that was removed and where it was before.
- A statement, under penalty of perjury, that you believe in good faith it was removed by mistake or misidentification.
- Your name, address and phone number, and a statement that you agree to the jurisdiction of the federal court for your address (or, if you're outside the United States, any judicial district where we can be found), and that you'll accept service from the person who sent the notice.
We'll send your counter-notice to the person who complained. If they don't tell us within 10 business days that they have filed a court case, we may restore the material in 10 to 14 business days.
Repeat infringers
Customers who repeatedly infringe copyright lose access to TrafficMaxxing. We count a customer as a repeat infringer after more than one valid notice that we have acted on. We may end access sooner for serious cases.
Music and other people's content
Customers must have the rights to any music, footage, images or other material they upload or add. Having a customer's upload in a workspace doesn't mean we approve it.
